Terms of Service

By creating an account or otherwise accessing or using the atom8er platform (“the Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you are accepting on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not access or use the Service.

atom8er is a cloud-based B2B sales pipeline and CRM platform that allows teams to manage leads, contacts, companies, tasks, and sales workflows. The Service is provided by atom8er (“we”, “our”, or “us”).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use.

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account. Accounts registered with automated methods are prohibited.

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay the applicable fees as described on our Pricing page
• Provide valid payment information; we will charge your payment method on the billing cycle you select
• Subscription fees are billed in advance and are non-refundable except as required by law or stated in our refund policy
• Prices may change with [30 days] notice. Continued use after the price change takes effect constitutes acceptance

We use [PAYMENT PROCESSOR] to process payments. By providing payment information, you agree to their terms.

Free trials: If offered, free trials convert automatically to a paid subscription at the end of the trial period unless cancelled beforehand.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or engage in deceptive practices
• Upload or distribute malware, viruses, or malicious code
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Scrape, crawl, or harvest data from the Service in bulk
• Resell or sublicense the Service without our written consent
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Store or process data that infringes third-party intellectual property rights

We may suspend or terminate your account if we determine you have violated these rules, at our sole discretion.

Our IP: atom8er and its licensors own all rights, title, and interest in and to the Service, including all software, trademarks, logos, and documentation. These Terms do not grant you any ownership rights.

Your data:You retain all rights to the data you input into atom8er (“Customer Data”). You grant us a limited, non-exclusive licence to process Customer Data solely to provide the Service to you.

Feedback: If you provide suggestions or feedback, we may use them to improve the Service without any obligation to you.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOM8ER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE [12 MONTHS] PRIOR TO THE EVENT GIVING RISE TO THE CLAIM OR (B) [$100 USD].

You agree to indemnify and hold harmless atom8er and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any Customer Data you submit.

By you: You may cancel your account at any time through account settings or by contacting us. Cancellation takes effect at the end of the current billing period.

By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we are required to by law.

Upon termination, your right to use the Service ceases. You may export your data prior to cancellation. Sections that by their nature should survive termination (IP, liability, indemnification) will do so.

These Terms are governed by the laws of Chennai, Tamilnadu, India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Chennai, Tamilnadu, India, and you consent to personal jurisdiction there.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

We may update these Terms from time to time. When we do, we will update the version number and “Last updated” date at the top of this page. For material changes, we will notify you via email at least [30 days] before they take effect.

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
